New Delhi: The Delhi High Court on Wednesday said it would hear on October 22 a plea by All India Students’ Association (AISA) president Neha Bora challenging a Delhi Police notice that asks her to execute a peace bond before a Special Executive Magistrate (SEM).

Justice Subramonium Prasad deferred the hearing at the request of Bora’s counsel. The matter was listed after she sought an urgent hearing, as the High Court is closed this week for the Dussehra vacation.

The notice, issued on October 17 under Section 126 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), directed Bora to appear before the SEM on October 19 and explain why she should not be made to furnish a personal bond of Rs 10,000 with one surety to keep the peace during the period of inquiry.

Bora was placed in preventive detention on October 16 while on her way to join the Cockroach Janta Party’s “Lehra Do Tiranga” march, and was released the following day.

In her petition, drafted by advocate Abhik Chimni, she argues that the notice is vague, factually incorrect and contains no material to show any likelihood of a breach of peace. She has also sought protection from coercive action by the police. Delhi Police have not yet responded in court.

Separately on Wednesday, leaders of the Cockroach Janta Party withdrew their Delhi High Court plea challenging their judicial custody. The detentions and notices follow weeks of protests in the capital demanding the resignation of Chief Election Commissioner Gyanesh Kumar over alleged irregularities in the Special Intensive Revision of electoral rolls.
