Court to Hear Plea Seeking cancellation of Rahul Mamkootathil's Bail on Friday

Thiruvananthapuram: Further arguments in the petition seeking cancellation of bail for Rahul Mamkootathil will be heard on Friday by the Judicial First Class Magistrate Court in Thiruvananthapuram. The petition was filed by the investigation team in connection with the second rape case against the former Congress leader, alleging that he violated the conditions of the bail granted earlier by the court. The defence has already submitted a written response opposing the plea for cancellation of bail.


The prosecution alleged that Rahul contacted the survivor through WhatsApp calls despite strict bail conditions prohibiting him from communicating with the complainant or attempting to influence witnesses. According to the complaint filed by the woman, he tried to intimidate and influence her after the court granted him bail. Based on this complaint, the prosecution approached the court seeking cancellation of the bail order.


During the hearing, the prosecution rejected the MLA’s claim that a missed call to the survivor’s phone had been sent accidentally. Prosecutors argued that such a call could not have occurred by mistake because the number would not appear in the call history unless it had been deliberately dialled. They maintained that the accused’s explanation does not stand either legally or factually.


Rahul Mamkootathil had been granted anticipatory bail earlier in the case involving allegations of rape against a 21-year-old woman, with strict conditions imposed to ensure the survivor’s physical and mental safety and to prevent any contact with her. The prosecution told the court that he allegedly contacted the survivor the very next day after she gave her confidential statement before the court, which they say constitutes a clear violation of the bail conditions.


Two sexual harassment cases have already been registered against Rahul Mamkootathil. The allegations against the former Youth Congress state president have also triggered widespread discussion in political circles.
