Supreme Court’s Bizarre Remarks on Premarital Relationships Spark Controversy

New Delhi: Recent remarks made by the Supreme Court of India on premarital relationships have sparked widespread debate. The court observed that, prior to marriage, a man and a woman are strangers and therefore physical intimacy should be approached with caution.
The observations were made by Justice B V Nagarathna while hearing a bail plea filed by a man arrested on charges of rape on the promise of marriage. During the proceedings, the judge advised young people not to blindly trust anyone before marriage and to exercise extreme caution when dealing with individuals they do not know well.
The bench acknowledged that such views may appear old-fashioned to some but noted that they hold relevance in the present social context. It also observed that individuals raised in more conservative environments may be less likely to enter into such relationships.
The case pertains to allegations of rape on the pretext of marriage, with incidents reportedly occurring in Delhi and Dubai. The court also made controversial point that the matter should not necessarily be confined to trial alone and suggested that mediation could also be explored as a possible course of resolution.
The bench further remarked that it is difficult to fully comprehend the implications of entering into physical intimacy with someone met through a matrimonial website.
The court’s observations have drawn criticism from certain quarters, with some arguing that they amount to moral commentary and encroach upon personal freedom. The remarks have since triggered a broader public discussion on consent, autonomy and the boundaries of judicial observation.
