CPI M Condemns Anti- Constitutional Remarks by Bombay High Court Bench

New Delhi: The Polit Bureau of the Communist Party of India (Marxist) has strongly condemned the observations made by the Bombay High Court while dismissing the Party’s petition against the Mumbai Police’s denial of permission to hold a protest condemning the ongoing Israeli genocide in Gaza.


In a statement issued on Friday, the CPI M described the court’s remarks as “anti -Constitutional” and “politically biased,” asserting that they appeared to reflect the position of a specific political party. The court, in rejecting the CPI M’s plea, went so far as to question the Party’s patriotism.


The High Court bench remarked:

“You don’t know the dust it could kick up. Getting on to the Palestine side or the Israel side. Why do you want to do this? It’s obvious, going by the party you represent, that you don’t understand what this could do to the foreign affairs of the country.”


The court further added:

“You are an organisation registered in India. If you could take up issues like garbage dumping, pollution, sewerage, flooding... You are not protesting on those but on something happening thousands of miles outside the country.”


The CPI M sharply criticised these statements, saying they demonstrate a disturbing ignorance of constitutional principles and of India’s longstanding commitment to the Palestinian cause. “From Mahatma Gandhi in the 1940s to the foundational years of India’s foreign policy, this country has never hesitated to support the legitimate rights of the Palestinian people,” the Polit Bureau said in its press release.


The statement further highlighted global condemnation of Israel’s military actions, including from the United Nations and the International Court of Justice, and said the court’s approach was “insulated from reality” and reflective of an increasing intolerance toward democratic dissent.


The CPI M called on all democratic- minded and freedom -loving citizens to reject this dangerous trend and to stand in solidarity with the oppressed people of Palestine.
