Must Hand Over Mobile Phone, Undergo Sexual Potency Test, Appear Regularly for Questioning: Court Directs Rahul Mamkootathil

Kochi: Congress MLA Rahul Mamkootathil has been granted anticipatory bail in a rape case, subject to stringent conditions. The order was issued by Justice Kausar Edappagath of the Kerala High Court.


As part of the bail conditions, the court directed Mamkootathil to appear for questioning for three consecutive days starting Monday. He has also been instructed to appear before the investigating officer on every second Saturday. The court further ordered that the mobile phone allegedly used to capture the complainant’s nude images be handed over to the investigation team. Additionally, he must undergo a medical sexual potency test as part of the probe.


In the event of arrest, the court directed that he be released on bail upon executing a bond of Rs 1 lakh with two sureties for an equal amount.


The court observed that the allegation that the complainant was forced to undergo an abortion due to pressure from the accused would have to be established during the trial.


According to the prosecution, the case against Mamkootathil is that he sexually assaulted the woman on the promise of marriage, resulting in pregnancy, and subsequently compelled her to undergo an abortion. The complainant opposed the grant of anticipatory bail, informing the court that her life would be at risk if the accused were released and informed court that he had similarly exploited other women.
